The present general conditions of sale, are carried systematically to every purchaser's knowledge to allow him to place order on the present Internet site to the exclusion of all other conditions, notably those in force in the stores.
Consequently, the fact to place order, imply the whole adherence and without reserve of the purchaser to these general conditions of sale to the exclusion of all other documents, as prospectus, catalogs gave out by the seller, who only have an indicative value.
The fact that the seller he doesn't prevail at one time of one any of the present general conditions of sale, cannot be interpreted like being worth renunciation to take advantage subsequently of one any of the aforesaid conditions.

Article 3: Formation of the contract and orders

3.1. price

The selling prices of the online products on the medalio.fr site, indicated in Euros, are those in force at the time of the registration of the order form by the purchaser.
They don't understand the expenses of expedition, invoiced in supplement of the price of the products bought. The expenses of expedition will be indicated before the registration of the order by the purchaser.
The prices consist of the value-added tax (T.V.A) enforced to the day of the order and all change of the rate applicable T.V.A will have reverberated automatically on the price of the products sold by Medalio within its Internet website.
The selling prices of the products can be modified at all times by Medalio. This modification will be signalled to the purchaser before all order.

3.2. feature of the products - Availability

In accordance with the article L 111-1 of the Code of the Consumption, the purchaser can, previously to his order, to take knowledge, on the medalio.fr site, of the essential features of the products that he wants to order.
The purchaser selects one or several products among the different categories proposed on the medalio.fr site: padlock, cat, dog, mouse, etc.
The offers presented by medalio.fr are valid in the limit of the available stocks.
The photographs, graphics and the descriptions of the products proposed to the sale are only indicative and don't hire the seller not at all. The photographs of the products are not contractual.

3.3. order

All order supposes the adherence without restriction nor reserve to the present general conditions of sale.
From the moment where the purchaser recorded his order, he is considered like having accepted in knowledge of reason and without reserve the present general conditions of sale, the prices, volumes and quantities of the products proposed to the sale and ordered.
The purchaser's order should be confirmed by medalio.fr, by electronic mail.
The sale won't be considered like definitive that after the consignment to the purchaser of the confirmation of the order by Medalio and roadbed by this one of the entirety of the price.
Medalio recommends to the purchaser to keep these information on a document paper or computer.

3.4. payment of the price

The payment of the totality of the price must be achieved at the order time by the purchaser. To no moment, the paid sum won't be able to be considered like deposits.
The roadbed of the totality of the amount of the order will be done by Medalio at the validation time of the order or in case of payment by check at the time of its receipt.
All orders are payable in Euros.
To adjust his order, the purchaser has the set of the payment method within the order form: credit card (blue card, Mastercard, Visa) and check.
The purchaser guarantees to Medalio that he possibly has some authorizations necessary to use the method of payment that he will have chosen, at the time of the registration of the order form.
Medalio reserves the right to suspend or to cancel all order and/or delivery, whatever are their nature and level of execution, in case of non-payment of all sum that would be owed by the purchaser, or in case of incident of payment.
Penalties of an amount equal to the legal interest rate raised of five points are enforced to the unpaid amounts at the end of a delay of ten days following the date of invoicing where since notification of the banking payment dismissal for all other means of payment. The delivery of all new order will be able to be suspended in case of delay of payment of a previous order and this in spite of arrangements of the present.
Medalio reserves the right to ask for a photocopy of the purchaser's identification card for all payment by banking card.
In the setting of struggle against the fraud on Internet, the relative information to your order will be able to be transmitted at third for verification.

Article 4: Delivery and receipt

4.1 general rules

Your order is delivered by La Poste to the address of your choice as indicated during the process of order. These delays are communicated for information only.
All possible overtaking won't be able to lead to damages, restraint or annulment of the order by the purchaser.

The delivery is limited to the France Métropolitaine, Monaco and Corsica.
Our sales and prices get along to the departure of Paris. The packets, of which you are the owner since the consignment, are addressed you by postal way and we negotiate for your account the expenses of registration with The Post office.
Due to a lack of respect of the procedures exposed below, no complaint of the purchaser will be accepted.

4.2 problems of conformity

In case of delivery of a product not corresponding to the order (deficient or non compliant), the purchaser must formulate his complaint within 7 days from the delivery, tampon of "La Poste" office making faith.
The complaints must be addressed by registered letter with acknowledgment to the address indicated to the paragraph 2 of the present, and must include:

  • the motives of the complaint.
All product to exchange or to repay should be return in Medalio in its state and packing of origin and include the set of the product and its accessories.
All risk bound to the return of the product is in charge of the purchaser.
Due to a lack of respect of the procedure exposed above and of the indicated delays, the purchaser won't be able to formulate any complaint for non conformity or obvious vice of the delivered products, the products being reputed compliant and exempt of all obvious vice.

Article 5: Availability of the products

Our offers of products are only valid in the double limit of the length of validity of the offer concerned and of the available stocks. In this setting, indications on the availability of the products are provided you at the time of the transfer of your order. In case of unavailability of the product after transfer of your order, we commit to inform you by e-mail in the 8 days and to indicate you the delay of waiting for receipt of this product. If you want it, you will be able to ask for the annulment (repayment by check within 15 days) or the exchange of your order or while contacting us by e-mail to: medalio@tiscali.fr

Article 6: Right of Recantation

In accordance with the article L 121-16 of the Code of the Consumption, the purchaser has a delay of seven straightforward days from the date of receipt, to return to his expenses, the ordered products, for repayment.
The products must be return imperatively in Medalio in a perfect state of resale, in their state of origin (packing, accessories…), sealed duly, and accompanied of the invoice corresponding to the purchase.
All incomplete product, damaged, or of which the packing of origin will have been damaged, won't be repaid nor exchanged.
The exercise of the recantation right will give place by choice of the purchaser:
- either to a repayment in cash, by credit of the banking card seized at the time of the initial order or, in case of impossibility, by letter check,;
- either to the assignment of a purchase order, in the conditions expressed below to the point 10.

Article 7: The repayment

If your product doesn't correspond to your waiting, don't have any concern. Simply return it us with the invoice and in its packing of origin, perfects state of it, in the 7 days of its receipt by your care. We commit to exchange it to you or if you wish it, to repay it to you by check in the 15 days of its receipt by our care. Article 8: Reserve of property

Medalio keeps the property full and whole of the products sold until the perfect roadbed of the price, in principal, expenses and taxes.
During the period flowing out of the delivery to the transfer of property, the risks of loss, flight or destruction are in charge of the purchaser.
The purchaser who don't respect the execution of its obligations of payment confers to the seller the right to require the immediate restitution of the goods delivered to the expenses and the purchaser's risks.

Article 9: Responsibility

The products proposed by Medalio are in conformity with the French legislation in force.
Medalio won't be able to be held for person responsible of the disrespect of the contract in case of rupture of stock or unavailability of the product, by force major, of disruption or total or partial strike notably of the postal and middle services of transportation and/or communications.
Medalio won't be able to be held for person responsible of all indirect damages that could occur because of the purchase of the products.
The medalio.fr site also contains the information coming from tierces people, and of the ties verses other sites web. Medalio won't be able to be held on no account for person responsible of the damages resulting from use of, of the access to, or of the inability to use this information, nor to the content of the other sites web.

Article 10: Applicable law

The sales of products of the Medalio society are submitted to the French law.

Article 11: Data processing and Liberties

The information collected by Medalio at the purchaser's time order are necessary for the management of his Medalio order and its commercial partners. In accordance with the Computer law and Liberties n°78-17 of January 6, 1978, the purchaser has a right of access, rectification, opposition and deletion to the data concerning it by Medalio.
Through the intermediary of Medalio, the purchaser can be brought to receive the commercial propositions of other organisms or enterprises, or to be informed of the offers of medalio.fr. If the purchaser doesn't wish to receive these propositions, he can inform some by mail in : GHAMO / Medalio 23, Rue Clément Roassal - 06000 NICE, or by e-mail to medalio@tiscali.fr.
